Terms and Conditions of Living DMC

Living DMC offers a wide variety of tours, tickets, and services (hereinafter referred to as "products") through its website (www.livingdmc.com).

As our Terms and Conditions contain legal obligations, we suggest reading them in full and with utmost attention. They form the basis on which bookings are accepted by Living DMC.

Unless otherwise stated, purchases made through the Livingdmc.com website are subject to these Terms and Conditions. In all booking procedures, the person making the reservation must be responsible for having accepted these conditions on behalf of the individuals mentioned in the reservation.

Any variation of these Terms and Conditions will be considered null and void unless duly authorized in writing by Living DMC.

Terms of Use

By using the Livingdmc.com website, you agree to be legally bound by these terms, which come into full force and effect immediately. If you do not agree to be legally bound by all the following Terms and Conditions, do not access and/or use the Livingdmc.com website or any affiliated site of Living DMC. Living DMC may amend these Terms and Conditions at any time by posting amendment(s) online. Please check these Terms and Conditions periodically to ensure that you are aware of any changes made by Living DMC. Your continued use of the Livingdmc.com website after the changes are posted constitutes your acceptance and ratification of being legally bound by these terms, as updated and/or amended. You are not authorized to copy, reproduce, republish, download, post, transmit, publicly display, or otherwise use the content of Livingdmc.com (including texts, images, URLs, price information, etc.) in any way, except for personal and non-commercial use. Any other use of Livingdmc.com content requires prior written authorization from Living DMC. You agree to use Livingdmc.com solely for legal purposes and in a manner that does not infringe the rights of, restrict, or inhibit the use and enjoyment of any other person with respect to Livingdmc.com. The use you make of Livingdmc.com is intended for personal and non-commercial purposes and/or to make legitimate booking requests for the products or services offered. You agree not to use this site to make any speculative, false, or fraudulent requests. You agree not to use robots or other automated means to access this site unless specifically permitted by Living DMC. You represent and warrant that (a) you have not been previously suspended by Living DMC or banned from the site in any way; (b) you are not a direct competitor of Living DMC; (c) you do not have more than one Living DMC account at any time; and (d) you have full power and authority to access these Terms of Service, and by doing so, you will not violate any other contract you are a party to. We grant you permission to use the site subject to the restrictions described in these Terms and Conditions. By accessing or using the site, you may be exposed to offensive, indecent, inaccurate, objectionable, or otherwise inappropriate content. Living DMC does not endorse such content and cannot guarantee its accuracy. Therefore, you access and use the site at your own risk.

User Accounts

You need to create an account and provide information about yourself to use certain features of the website. You are responsible for maintaining the confidentiality of your account password. You are also responsible for all activities that occur related to your account. You agree to notify us immediately of any unauthorized use of your account. Your account must be used for personal and non-commercial purposes only. You are not authorized to impersonate someone else (adopt the identity of a celebrity), create an account for someone else, provide someone else's email address, or create more than one account.

We reserve the right to terminate your account at any time, with or without reason.

You can contribute to the website in various ways, including posting reviews and comments, uploading photos to the site, adding information to your public profile, and rating contributions from other users (hereinafter referred to as "Your Content").

You may be exposed to liability if Your Content violates any third-party rights, including copyrights, trademarks, patents, trade secrets, moral rights, privacy rights, publicity rights, or any other proprietary or intellectual property rights; if the Content contains material that is false, intentionally misleading, or defamatory; contains material that is unlawful, including hate speech or illicit pornography; if it exploits or otherwise harms minorities or advocates the infringement of any law or regulation.

We may remove or reinstate User Content from time to time at our sole discretion. For example, we may remove a review if we have sufficient reason to believe that it violates the guidelines governing our content. We have no obligation to retain or provide copies of your Content, nor do we guarantee confidentiality regarding the same.

Living DMC and its affiliates may display advertisements and other information adjacent to or included in the Content on the Site and Other Media. You are not entitled to any compensation for such ads. The manner, mode, and scope of such advertising are subject to change without any specific notice to you.

Product Validity, Modifications, and Corrections

All products, tours, and services offered by Living Tours are valid as displayed on Livingtours.com or any affiliated website of Living DMC. Living DMC is not responsible for any information provided indirectly.

All requests for modifications/corrections should be directed to the Living Tours Customer Service Team, who will process the request.

Living DMC does not charge a fee to correct or change the dates of an existing booking as long as the request is received by the Customer Service team more than 3 (three) days in advance of the confirmed date for your travel.

It is not possible to change or modify a ticket for a special event, theater, or show. Sales of these tickets are final and cannot be altered once your original purchase is confirmed.

All other requests for date changes and corrections are subject to availability from other suppliers and/or service providers; Living DMC cannot guarantee the success of any date change request.

If you request a date change within 3 (three) days or less of the confirmed travel date, Living DMC will attempt to honor your request; however, changes made within three days or less of the original travel date may incur an additional fee. For multi-day and evening tours, date changes made within 7 (seven) days of the confirmed travel date may also include additional fees from our suppliers and/or service providers.

If you make a purchase using a Living DMC promotional code or if you accept a discount or special offer price during the Living DMC purchase process, you may invalidate your discount or special offer price by making any changes or corrections to your itinerary after your purchase is completed. Living Tours may decide, at its sole discretion, whether to honor your discount or special offer price if you make a post-purchase change or correction to your itinerary. Living Tours reserves the right to invalidate your discount or special offer price if you make any changes to a confirmed itinerary.

Occasionally, our suppliers and/or service providers make changes to tour dates, prices, inclusions, coverage, age requirements, etc. Therefore, Living DMC reserves the right to cancel, change, or substitute any reserved service, tour, ticket, or product on Livingdmc.com at any time for any reason.

In such cases, if you are not satisfied with the offered alternatives, you will be eligible to receive a full refund of the original purchase price.

Notwithstanding the foregoing, when we are informed in advance by our representatives, service providers, and/or suppliers of a significant change to a reservation and/or to a tour, product, or event, we make every reasonable effort to notify the customer, travel agent, and/or distributor, as appropriate, to rectify or reissue the reservation, if possible.

Prices and Inclusions/Exclusions

The prices listed on Livingdmc.com are per person unless otherwise specified.
Prices are based on the local rate at the time of quotation, converted to the prevailing international exchange rate as determined by Living DMC.
Price quotes are subject to change without notice until a reservation is confirmed.
Unless otherwise specified, prices do not include local taxes or usage fees, including departure fees, security fees, port fees, parking fees, customs fees, immigration fees, agricultural fees, passenger facility charges, or international transportation fees.
Prices do not include gratuities/rewards to tour directors, drivers, or local guides; passport and visa fees; baggage and personal insurance; any personal items; and beverages or meals not specifically listed under "Inclusions" on the product pages of Livingdmc.com or affiliated websites of Living DMC.

Payments and Cancellations
Living DMC accepts payments through the Paypal system, using your Paypal account or credit cards: VISA, MASTERCARD, or AMERICAN EXPRESS.
There is no charge or service fee for processing payments by credit or debit card.
Full payment with a credit card or Paypal is required to make a reservation. The payment will be listed as LIVINGDMC on the credit or debit card statement.
No refunds will be provided once the tour or service has commenced or for any package, accommodation, meal, or any other service used.
Canceling a reservation with Living DMC may result in cancellation fees imposed by Living DMC, as described below. Additional fees may be imposed by individual suppliers/operators (refer to the Living DMC Voucher for specific details). Upon canceling any reservation, you will be notified via email, fax, or telephone regarding the total cancellation fees.
Event tickets, attractions, theaters, shows, or vouchers
These items are non-refundable under any circumstances.
Gift Vouchers.

These items are non-refundable under any circumstances.
Tour or package starting during a special event period
These items are non-refundable under any circumstances. This includes, but is not limited to, Trade Fairs, Public or National Holidays, School Holidays, New Year's Day, Thanksgiving, Christmas, Easter, and Ramadan.
Other tour products and services
If you cancel with at least 7 calendar days in advance, there will be no cancellation fee.
If you cancel between 3 and 6 calendar days in advance, you will be charged a 50% cancellation fee.
If you cancel with 2 calendar days in advance, you will be charged a 100% cancellation fee.
Transaction amounts may be subject to foreign transaction or exchange fees. Your credit or debit card company may convert the payment into the local currency and charge fees, resulting in differences between the amount displayed on Livingtours.com and the final amount charged to the credit or debit card statement. Please contact your bank or card company if you have any questions about any conversions or applicable fees. Notice for bookings made in Brazil: the IOF (Financial Operations Tax, 6.38%) is not included in the final booking amount and will be charged to the credit or debit card used for the purchase.

Payment Processing

Under this agreement, payment processing services for services purchased on this website are provided by PayPal on behalf of Living DMC, according to the payment method used in the purchase of the respective services. Living DMCVouchers You will receive a personalized Living DMC Voucher for each tour, event, or service booked. To access or print your Living DMC Voucher(s), you will have access to a secure web page hosted by Living DMC with a link to your Voucher(s). You must provide the authentic original Living DMC Voucher to the appropriate service provider to redeem your tour, ticket, or package. Your booking cannot be honored or redeemed without presenting a valid Living DMC Voucher. For security purposes, when redeeming your Living DMC Voucher, you must present a valid photo ID and sign the Living DMC Voucher. This procedure is for security reasons and helps prevent and deter potential fraud attempts. In some cases, Living DMC also requires you to present the credit card used to purchase your ticket at the time of redemption. This generally applies only to show tickets and attractions. This procedure helps prevent and deter unauthorized use of credit cards. You will be informed during checkout whether or not you need to present the credit card used for the reservation. In some cases, Living DMC may waive this requirement, usually to facilitate gift purchases. However, this requirement can only be waived by contacting Living Tours' Customer Service team after your reservation is confirmed and any changes or corrections are made at the sole discretion of Living Tours. If you make a purchase using a Living DMC Gift Voucher, Living Tours will request that you present the Gift Voucher used to purchase the tour, ticket, or package at the time of redemption. Please note that your Living DMC Voucher(s) may be confiscated and canceled immediately without refund if your signature and/or name do not match those shown on the credit card or Gift Voucher.

Passports, Visas, and Insurance

It is the responsibility of all passengers, regardless of nationality and destination, to check the current entry requirements with the consulate of the country they are visiting.

As visa and health requirements are subject to change without prior notice, we recommend that you check the health and visa requirements with the appropriate consulate before departure.

We strongly recommend that you arrange a Travel Insurance Policy before departure. If you cancel your trip or significantly change the travel dates, there are several policies that will reimburse the cost of cancellation fees and related expenses.

Disclaimer and Limitations of Liability

Under no circumstances shall Living DMC or its representatives, affiliates, service providers, suppliers, and/or distributors be liable for the following losses or damages (whether such losses are foreseen, foreseeable, known, or otherwise): (a) loss of data; (b) loss of revenue or anticipated profits; (c) loss of business; (d) loss of opportunity; (e) loss of goodwill or damaged reputation; (f) losses suffered by third parties; or (g) any indirect, consequential, special, or exemplary damages arising from the use of Livingtours.com, regardless of the form of action.

Living DMC and its representatives and suppliers, when making arrangements for hotels, tours, transportation, or any services in conjunction with individual itineraries, shall not be liable for injuries, damages, loss, accident, delay, or irregularity, liability, or expenses to person or property due to any defect of any hotel, carrier, or other company or person providing the services included in the tours.

Furthermore, Living DMC and its agents and suppliers shall not be liable for any illnesses, thefts, labor actions, machinery breakdowns, government actions, acts of war and/or terrorism, weather conditions, defects in any transportation vehicle, or any accident or casualty or any other cause of force majeure.

The content of Living DMC, including information, names, images, photos, logos, prices, dates, and availability regarding or relating to Living DMC, Livingdmc.com, service provider, operator, and/or distribution partner, is provided "AS IS" and "AS AVAILABLE" without any representation or warranty of any kind (whether express or implied by law) to the extent permitted by law, including implied warranties of quality, satisfaction, fitness for a particular purpose, non-infringement, compatibility, security, and accuracy.

At Living DMC, we verify and confirm the accuracy of the details regarding all the products and services we offer. However, Living DMC does not guarantee that the functionality, content, or information contained on the Livingdmc.com website will be uninterrupted or error-free, that defects will be corrected, or that the Livingtours.com website or the servers that make it available are free from viruses or bugs.

If any of these terms are determined to be unlawful, illegal, invalid, or otherwise unenforceable under the laws of any state or country in which these terms are intended to be effective, to the extent and jurisdiction in which such term is unlawful, illegal, invalid, or unenforceable, that term shall be severed from these terms, and the remaining terms shall survive and remain in full force and effect and continue to be binding and enforceable.

You agree that you will not engage in the following actions, nor will you assist or enable others to engage in the following actions:

Use the website to threaten, stalk, deceive, incite, harass, or otherwise interfere with the use of another person on the site.
